Mark Speakman was the attorney general when the NSW police cleared David Elliott of impersonating a police officer. As the attorney general his role was to provide legal advice to the Government, and act as the representative of the public interest. The attorney general also has supervisory powers over the prosecution of criminal offences.

Given the serious threat to public safety caused by the police clearing Elliott of wrongdoing, Speakman should have taken steps to ensure Elliott was prosecuted. Given his inaction as attorney general, serious questions should be asked about Speakman's suitability to be opposition leader.
